Agreement of Terms

Due to the present insurance situation and legal atmosphere in Canada, we must insist that each participant be familiar with and agree to the following document. If you have any questions regarding any of the contents, please contact us prior to signing the document. The form must be completed and submitted prior to the beginning of your trip. No one may participate in a Arctic Range Adventure trip without submitting this document (a separate form is required for each participant).

No one may participate in a Arctic Range Adventure Ltd. trip without submitting this document.

Insurance coverage is the responsibility of each individual participant. Cancellations and travel coverage are available through travel agents.

VAN & BUS TOURS, NORTHERN LIGHTS (AURORA BOREALIS) VIEWING TOURS, CAMPING TOURS, SNOWSHOEING TOURS, ICE FISHING TOURS, X-COUNTRY SKIING TOURS, SNOWMOBILING TOURS, CANOEING TOURS, HIKING TOURS, AERIAL SIGHTSEEING TOURS - include hiking, canoeing, fishing, use of knives, saws, axes, mountain hiking, scrambling, nature observations, crossing streams while hiking, lifting, carrying skis and snowshoe equipment and other associated activities.

In consideration of Arctic Range Adventure Ltd. accepting my application I agree to this Release of Claims and Waiver of Liability.

I acknowledge that I have been advised to wear a helmet while participating in snowmobiling and life jacket (PFD) while participating in canoeing. I am aware that there are technicians available to answer questions I may have as to the proper use of the snowmobile or canoe. I am also aware that loose straps and clothing may become caught in the snowmobile during operation.

I understand that wilderness tripping involves certain dangers, not all of which can be listed here. Among the more obvious and frequent are:

  1. Violent and unpredictable weather, which may cause injury due to extremes of heat and cold and which may prevent travel to, from or within an area
  2. Hazards related to travel in and on lakes and rivers
  3. Unfamiliar country, where the participant may become lost, get off route or be separated from the rest of the party
  4. Remoteness of location with poor communication and inability to get rescue or medical assistance quickly or easily
  5. Medical problems arising before, during or after the wilderness trip
  6. Transport by public or private motor vehicle, helicopter and light fixed-wing aircraft
  7. Steep terrain where a fall or rock may cause injury or death
  8. Failure to follow directions from the guide, including those specifying:
  • staying with the group at all times unless the guide is consulted and provides consent,
  • wearing appropriate clothing for protection against unpredictable weather conditions,
  • safe use of tools and other wilderness trip equipment.

I agree to inspect all equipment before use and ask questions of facility employees if I do not fully understand how to use and/or operate the equipment or facilities. I accept any equipment AS IS and agree to return any equipment before use that I believe to be damaged or defective for replacement or repair.

I acknowledge receipt of rental equipment for myself AND participants registered under name. I accept responsibility for the same while in possession and agree to return all rental equipment at or before the termination of the rental period. I understand I will be liable for up to the full replacement value of rental equipment not returned and for any extra charges (or full replacement value) if the equipment is damaged beyond normal wear or destroyed beyond repair.

I am not relying on any oral or written statements made by Arctic Range Adventure Ltd. or its agents, whether in brochures, advertisement, videotapes, in individual conversations or otherwise to lead me to become involved in this program on any basis other than my assumption of the risks involved.

I accept all of the risks and the possibility of death, personal injury, property damage and loss resulting from my involvement with the trip I am taking with Arctic Range Adventure Ltd.

I release Arctic Range Adventure Ltd., its officers, employees, guides, agents and representatives from any and all liability for any personal injury, death, property damage or loss I may suffer as a result of my participation in their trip, for any cause whatsoever on the part of Arctic Range Adventure Ltd., its officers, employees, guides, agents or representatives.

I certify that I am physically capable and fit to participate in this activity and I have no medical conditions or needs other than those listed below.

I confirm that I am eighteen years of age or older. (Younger participants must have a parent or guardian read and sign this document.)

I confirm that I have read over this agreement before signing, that I understand it, and that it will binding not only me, but also on my heirs, my next of kin, my executors, administrators and assigns.

I agree that the laws of the Yukon Territory govern this contract and that any legal concerns will be handled in the competent and fair courts in Whitehorse, Yukon, Canada.

I hereby grant other members of the trip to take film and photographic records of my participation in this tour. I hereby grant Arctic Range Adventure permission to use my likeness in a photograph, video, or other digital media (photo) in any and all of its publications, including web-based publications, without payment or other consideration.
